More than half of the United States is covered by 2nd Amendment Sanctuary Movement

While gun control efforts are not new in recent years, they have been increasing in recent years. This is making lawful gun owners extremely uncomfortable. What was the best solution? Take the Democrat approach and create 2nd Amendment sanctuary counties, states, and cities. If they can create sanctuary cities/counties/states for illegal immigrants, then the same is possible to protect a constitutional right.

What is the 2nd Amendment Sanctuary Movement Movement?

The Second Amendment Sanctuary movement is, in short, a direct response of the federal government’s increased gun control proposals. Universal background checks and “red Flag Law” legislation place law-abiding gun owners at risk.

This is directly contrary to the Constitutional rights of Americans. The United States Supreme Court affirmed this right in District of Columbia v Heller (554 U.S.570 (2008). The Second Amendment explicitly guarantees the right to keep and bear weapons, according to the ruling. It is therefore a fundamental right.

Pro-gun advocates sent a clear message of support to politicians when local governments passed Second Amendment Sanctuary Resolutions. These resolutions declare that any restrictive gun control laws passed either by the federal government or a state legislature violate the Constitution.

The resolutions have led to County Sheriffs stating that they will not enforce restrictive gun control measures such as firearm confiscation statutes and gun safety laws.

Legalities of Second Amendment Sanctuary Resolutions

It is important to remember that federal law prevails over state law and local ordinances when it comes to Second Amendment rights. If there is a conflict, then the Federal District Court in the state decides the constitutionality and validity of any infringements on your firearm rights. Appeals are possible, and would be heard in the federal circuit courts or the U.S. Supreme Court.

Many people view Second Amendment sanctuary resolutions mainly as symbolic, but the movement is gaining enough ground that it can be legitimate.

Bryan Kibler, the Illinois state’s attorney for Effingham County, told Rolling Stone Magazine that the idea was actually a success. We are standing up for ourselves.”

Many state attorneys general warn localities that they could face lawsuits or court challenges if they cease to enforce state gun laws.

In the case involving Washington Attorney General Bob Ferguson he threatened to hold law enforcement responsible for misuse of firearms from a prohibited individual.

“However, if a police chief or sheriff refuses the required background check under Initiative 1639, they could face liability if a firearm is sold or transferred to a dangerous person prohibited from possessing a firearm, and that person uses the firearm to do harm.”

This doesn’t account for the possibility that a criminal illegally obtains the firearm.

The United States v The State of Missouri is currently pending. It was filed in February 2022. The outcome of this case will set a precedent and help determine if it is just symbolic or has any merit. We will keep an eye on the outcome and report any changes.

Second Amendment Sanctuary Movement Gains Ground

At the time of writing, 19 states have adopted 2nd Amendment Sanctuary status. It is interesting to note, however, that some states adopted similar resolutions long before “Second Amendment Sanctuary” was a thing.

States currently in 2nd Amendment Sanctuary status include:

This represents just over one-third the country, and it is growing. The real story is the number and type of Second Amendment Sanctuary County counties. According to SanctuaryCounties.com, as of September 2019, 1,965 counties have adopted 2A Sanctuary laws. This represents 62.5% American counties.

The gun control crowd may have difficulty accepting this movement, regardless of whether they like it or otherwise. This is a steep hill to climb. We don’t like their indifference to our Constitution, the American people have spoken.
