UPDATE: Indiana Constitutional Carry to the Win

We recently reported that a good man with a gun stopped a mass killing in an Indiana mall. Details were not available at the time of this report. New details have been revealed since then, and they are in direct contradiction to anti-gun rhetoric. It is specifically the Indiana Constitutional Carry Law that went into effect July 1st that was responsible for stopping it.

Indiana Constitutional Carry Saves Lives
Let’s first give credit where credit is due. The 22-year-old law-abiding gun owner who prevented the tragedy is now known. He is Elisjsha Dicken and it turns out that he is quite a badass. We have learned that he stopped the shooting in just 15 seconds and did it from 40 feet away.
According to WTHR News: “At 5:57.03 p.m. Elisjsha Dicen, an armed bystander fired on the shooter 40 yards away,” according to police. Dicken fired 10 shots within 15 seconds of the shooting beginning. The shooter tried to retreat into a bathroom, but Dicken hit him with 10 rounds. He then collapsed and died.
Anti-gun activists have been questioning Dicken’s safety and asking where all his rounds went. The WTHR News story addresses that question.

“An autopsy revealed that the shooter was shot eight more times, none of which were self-inflicted.”
There are no reports that innocent bystanders were struck by errant rounds from Dicken’s firearm.
WTHR adds that Dicken does not have any training in military or police firearms. Instead, Dicken learned how to shoot from his grandfather. This is a great example of how to teach your children to shoot.
Is the Good Samaritan a Criminal?
Another indictment by the gun control crowd is that “Dicken broke law by carrying in the Mall.”

Let’s start with the obvious deflection. They never acknowledge that the suspect was also carrying something in the mall. The difference is that the suspect was carrying in an attempt to harm others, while the good guy was carrying in self-defense.
The fact that the suspect was only carrying one gun shows that “gun-free zones don’t work.” He most likely chose that location because he believed he would be the only one with guns. Dicken would not have known he was carrying a gun if he hadn’t started shooting.
IndyStar.com answers the question.
Guy Relford, an Indiana attorney, firearms instructor, and prominent voice on Indiana’s gun laws, stated that Greenwood Park Mall’s zero-weapons policy is similar to a “no shoe, no shirt, or no service” sign at a gas station. “Such signs simply state the policy of a business owner.”

The article continues to state:
“If a customer doesn’t adhere to the policy, a business can demand that they leave. If the customer refuses to comply with the request, it is considered trespassing and a crime in Indiana.
“But if Dicken was not asked to leave, he wasn’t trespassing.”
The Blaze reports that Dicken was also called a “hero” by City of Greenwood officials and stressed that he was ‘lawfully armed’ when he stopped a shooter.

A separate article on IndyStar.com says, “Greenwood Mayor Mark Myers spoke at Monday’s conference and praised Dicken for coming to his rescue within minutes of the initial shooting.”
Indiana Constitutional Carry Law
In my initial report, it was unclear whether the Good Samaritan was carrying under the new constitutional carry laws. It is now clear that he didn’t have a permit, but was legally able to carry a firearm under the new law. Just in time, the new law was passed.
Anyone who is legally allowed to own a firearm can carry a handgun in public. There is no permit requirement. You can still get a permit to carry. This will allow you to reciprocate in other states that have one.
USACarry states that concealed carry is legal as long as you are at least 18 years old and not prohibited from owning a firearm. This applies to both residents and non-residents in Indiana.

Indiana Permitless Carry Requirements
According to a PDF found on the Indiana State Police website you must not be a banned person to be eligible for permitless carry. This includes:
Person who has been convicted of a Federal or State offense and sentenced to a term of imprisonment exceeding one (1) year. 1481. A person less than 18 years old, unless authorized by IC 35-47-10.
This law was passed just in time to save many lives. We now know that the suspect was carrying two rifles, a pistol and several full magazines. This could have been much worse but for Indiana constitutional carry and one 22-year old.
