Second Amendment Groups Challenge New York Carry Bans

September 30, 2022. The cynical reaction of New York to the landmark NYSRPA v. Bruen decision, which affirmed a Constitutional right for firearms to be carried, was to ignore that decision completely. New York’s politicians are led by N.Y. Governor Kathy Hochul passed legislation (S51001), which made nearly all of New York “off-limits to” persons with carry permits. Because CCW use was prohibited in New York, the goal was to make New York CCW permits practically useless. Second Amendment advocacy groups FPC and SAF challenged the new restrictions in New York state. FPCLegal.org can view the motion. The motion can be viewed at FPCLegal.org. The FPC moved to halt enforcement of the new law. It also stated that “S51001 makes a mockery” of the Supreme Court’s Bruen decision, which affirmed that personal security “emphatically expands to include ordinary, law abiding Americans ‘outside of the home’. “The New York Legislature seems to believe that when the Supreme Court closed New York’s may-issue permit regime, it opened up a door for equally burdensome location restrictions,” stated Bill Sack, FPC Director of Legal Operations. The case will continue as plaintiffs for Brett Christian, Firearms Policy Coalition, Inc., Second Amendment Foundation. A motion to amend the caption and short title has been filed. If the motion is granted, the lawsuit could be re-titled “Christian et al v. Bruen”.
