California gun owners have good news. You can now order ammunition online and have them shipped directly to you in California. You can also buy ammo in California gun shops, without having to pay for a background investigation. A federal judge has issued an order that blocks the application of California laws that require expensive background checks for ammunition purchases. Currently, Californians are able to buy ammo with no restrictions. However, the Ninth Circuit may change this very soon. Act now. Californians can now purchase ammunition at a lower price by ordering it via mail from major vendors located outside of California. In the case of Rhode v. Bonta on January 30, 2024, U.S. Federal District Judge Roger Benitez issued a ruling blocking the application California laws that place severe limitations on ammunition purchases for Californians. Benitez ruled California’s laws that require background checks for ammunition purchases are unconstitutional on multiple grounds. The San Diego Union-Tribune reported: “U.S. District Judge Roger Benitez found that such restrictions violated the Second Amendment. He also ruled the portion of the law restricting purchases from out-of-state violated the dormant Commerce Clause, and is preempted under federal law regulating the interstate transportation firearms. The ruling of U.S. district judge Roger Benitez on Tuesday [1/30/2024] took effect immediately. California Attorney General Rob Bonta requested Benitez to delay the decision on Wednesday[.] It’s not clear if Benitez would grant this request. Four years ago in April 2020, Benitez issued a preliminary order blocking California’s background check laws on ammo. Days later, the 9th U.S. Circuit Court of Appeals issued a halt to that injunction. This effectively negated the Benitez ruling and put California’s unconstitutional law back into effect.
