Remington Arms Co Offers $33 million Settlement in Sandy Hook Suit

The Connecticut Supreme Court ruled in 2019 that Remington Arms could be sued by parents of twenty Sandy Hook students who were killed in the Sandy Hook shooting. Only nine families were involved in the lawsuit out of twenty.

Remington Arms Sandy Hook Lawsuit

The 2005 Protection of Lawful Commerce in Arms Act shields firearms manufacturers against liability for mass shootings. According to a 2019 Connecticut Supreme Court ruling, an exemption to the act was sufficient to allow the lawsuit to proceed. Manufacturers can still be held responsible for injuries caused by the marketing of their products despite this exception.

According to the Wall Street Journal, this ruling allows the families of the victims to continue with their lawsuit. They claim that Remington’s marketing violated Connecticut’s consumer protection law. Connecticut’s consumer protection law forbids advertising or marketing that is “immoral or unscrupulous.”

Bushmaster, a Remington company, featured an AR-15 image with the phrase “Consider Your Man Card Reissued.” The families use this advertisement as a basis for their lawsuit.

The Settlement

According to Reuters lawyers representing the families estimated that wrongful deaths claims could have reached more than $225 million. This could result in more than $1 billion in total claims, which includes punitive damages.

Remington Arms Co offered Tuesday to compensate the nine families nearly $33 million in an attempt to mitigate the damages. Each family would receive $3.66 million. The settlement must be approved by the Alabama federal judge who is overseeing Remington’s bankruptcy case.

The court filings don’t reveal which Remington’s insurances are funding the settlement. Although four insurers were listed in the bankruptcy case, they are not listed at the time of the shooting. Ironshore, which is owned by Liberty Mutual and James River Insurance Co. Chubb Ltd. as well as Swiss Re, are listed on the list of insurers. According to the Wall Street Journal, however, a person who has knowledge of the case stated that Ironshore is funding the settlement.

Connecticut law gives the families 60 days to review the offer. Josh Koskoff, the lawyer representing the families, stated that they will “consider their next steps.”

Koskoff stated that the families have been focusing on preventing Sandy Hook’s next attack since the case was filed in 2014. “An important part has been to show banks and insurances that companies that sell assault weapons for civilians pose financial risk.”
