The U.S. District Court for Central District of California heard a case in this matter. The court rejected claims Ventura and L.A. County’s coronavirus orders closing gun shops, ammo shops and gun ranges infringed the Second Amendment. A recent 9th Circuit federal appeals court ruling has declared the COVID gun store closings unconstitutional. In March 2020, Ventura and Los Angeles imposed a number of restrictions and stay-at-home orders. All non-essential businesses were subject to the 48-day order, which included gun stores, ammunition shops and firing ranges. Gun-rights advocacy groups like the Second Amendment Foundation filed suit, arguing that the orders were not constitutional. The bans were not blocked by the U.S. District Court for Central District of California. The groups appealed to the 9th Circuit Court of Appeals. The prohibitions were lifted, but the Appellate Court ruled that the cases were not abandoned because the plaintiffs were seeking no damages. The 9th Circuit Court’s Opinion in McDougall, County of Ventura makes it clear that this is an issue under the Second Amendment. Judge VanDyke stated in the ruling, “[T]he right for the people to keep an Arms,’ U.S. Cont. amend. If the government can ban all firearms or ammunition from being acquired, II means nothing. This is what happened in this case. He also clarifies that there was not enough evidence to support such actions. “The County did not provide any evidence or justification to allow bicycles to be purchased and delivered. However, firearms could not be picked up at the storefront. This is also true for outdoor activities like walking, biking, and golfing. However, outdoor shooting range proficiency was prohibited. The County simply has not provided any evidence to justify its actions. Judge Kleinfeld stated that neither a pandemic nor war can wipe out the Constitution. However, there is no way to reverse the damage done. This will hopefully set a precedent for the future. The worst is over, so this won’t be an issue in future.
