The law was originally introduced in 1990 by Joe Biden, then-chairman, Senate Judiciary Committee. It was signed into law in 1994 by Bill Clinton. The law created the Office on Violence Against Women in the Justice Department. It was passed three times, but it has been deadlocked for the past three. The domestic violence law was renewed by Congress at a recent session with bipartisan support. Since its inception, over $9 billion has been awarded to state and local governments as well as nonprofits and universities. These grants were used to fund crisis intervention programs, transitional housing, legal aid for victims, and other programs. Supporters claim that the bill’s reauthorization will increase spending on training law enforcement officers and the courts. According to the Associated Press, “Passage” of the legislation was a rare moment of bipartisan agreement in Congress. This was partly due to the strong personal connections that lawmakers have with domestic violence and its devastating consequences. However, a provision in the bill caused a halt in the process. The issue was centered on the addition of a provision that would prohibit misdemeanor stalking convictions from possessing firearms. The National Rifle Association resisted this. It is now clear how dangerous this provision is, just days after Jussie Smollet was sentenced for committing a hate crime hoax. Democrats have shown that they are willing to do whatever it takes to get what they want, as evidenced by the rise in hate crime hoaxes. They won’t let anyone down, and they won’t ruin any life. Stalking is not okay and is a red alert. A misdemeanor, however, is still a misdemeanor. At the moment, firearm ownership is restricted to felons. If this were to happen, how long would it take to abolish gun rights for misdemeanors as well? Some may argue that “if it only saves a life”, is true. We cannot punish an entire society for the wrongdoing of a few. That is not acceptable or justifiable. Moving Forward Fortunately, Democrats reversed their position and removed the provision. Despite grandstanding and bloviating the bill is still strong and allows people to get guns from those who pose a legitimate threat. According to the AP, domestic abuse victims can lose their guns if they are married or formerly married to the victim, live with them, have a child together, or are a victim’s parent or guardian. The law does not apply to stalkers or current or former partners. Advocates have called it the “boyfriend loophole”. But Sheila Jackson Lee, a lawmaker, vows to fight on. Jackson Lee stated that one of the best ways to help women was to get the gun from the hands of the abuser. This is not a NRA question. This is a human question,” she continued. “This is saving children and women.” This is stepping into their shoes.” You will notice that they are focusing on one type of violence, gun violence. I will not be opposed to the importance of the law. Their focus on guns is telling and almost “Trojan Horse-like”. Any Trojan Horse would smell just as bad. The midterm elections are coming, but it is not looking good for the Democrats, fortunately for responsible gun owners. A Republican sweep in November would be a significant step towards ending the Democrats’ gun-grabbing efforts. I know exactly where I will be on November 8th. What about you?
