Biden Administration Will Restrict U.S.-Made Firearms Exports

The Biden administration will, through the Bureau of Industry and Security of the Commerce Department (BIS), impose new restrictions on gun exports starting May 30, 2024. These restrictions will apply to a wide range gun exports worldwide. These new restrictions are in response to the “pauses” on gun exports mandated by last October. Fox News explains that the Biden administration will impose new firearms export restrictions and increase scrutiny of transactions, a Commerce Department official announced late on Thursday. The Department of Commerce paused most firearm exports on Oct. 27, to assess the risk that firearms would be diverted to entities and activities that promote regional stability, violate human rights or fuel criminal activity. The Department will announce on Friday when it will lift the suspension on May 30, the date the new restrictions come into effect. The Commerce Department expects that the restrictions will result in a 7% decrease, or $40 Million, in the average annual U.S. gun exports of $600 Million, according to the official. SEE Legal Analysis. Biden Administration Restriction on Firearms ExportsLarry Keane Senior Vice President, NSSF “President Joe Biden’s relentless rebukes against the firearm industry and law abiding gun owners aren’t just a violation of our Second Amendment rights. It’s a well-financed and calculated attack on the fabric American liberty. President Biden calls firearm industry “the enemy” and his administration is systematically trying to dismantle industry and pandering to the whims and radical gun control lobbyists. The statistics are damning and the evidence is clear. The Bureau of Industry and Security of the Department of Commerce (BIS) has recently finalized a new rule that makes a 90-day ‘pause’ on firearm exports a permanent policy and creates burdensome regulatory requirements. This policy, sold under the guise national security will hurt the U.S. gun industry’s competitiveness. It will also cost thousands of well-paying jobs. The economic impact of this policy is staggering. Estimates are well over $250 million. This is a devastating blow for an industry already reeling under government overreach. This new Department of Commerce Rule will go into effect on 30 May 2024. Federal Register explains the new firearms export policies: “In this interim-final rule (IFR), Bureau of Industry and Security is amending Export Administration Regulations to enhance the control structures for firearms and other related items[.] This rule identifies semiautomatic firearms as being under new Export Control Classification Numbers. It also adds additional licensing requirements for Crime Control and Detection items, resulting in additional restrictions to the availability of license exemptions for most destinations. It also amends the license review policies to be more explicit about the nature of the review that will accompany various types of transactions and the license exception availability. This rule will be effective on May 30, 2024.”
