Following the SCOTUS Decision, States are changing Concealed Carry Restrictions

It didn’t take too long. The landmark U.S. Supreme Court decision in New York State Rifle & Pistol Association v. Bruen stricken down New York’s restrictive and subjective “may-issue” pistol permit license requirement. This ruling is already reverberating across other states with similar restrictions. States with similar restrictions on concealed carry are now complying with the ruling.

States Change Concealed Carry Restrictions Quickly
Eight states had “may issue” laws before the Supreme Court decision. It’s not surprising that states that must adjust their conceal carry permit programs are antigun states. Antigun governors and legislatures have already imposed some of the most strict gun control laws in the country. Criminals continue to ignore laws old and new.
New York
New York’s gun control leaders weren’t happy with the SCOTUS decision. New York Governor Kathy Hochul said, “I’m absolutely stunned.” Kathy Hochul spoke while announcing an “extraordinary” special legislative session to enforce more gun control policies following Bruen. New York passed stricter gun control laws in an overnight anti-gun deal. These laws went beyond the requirements for concealed carry permits.
New York was told by Bruen that it could not be subjective in issuing carry permits to law-abiding citizens. However, the legislature doubled down and required personal social media accounts to submit new laws. This still uses subjective criteria to approve permits.

The new law not only violates the Second and Fourteenth Amendments, but also the First Amendment freedoms. New Yorkers are prohibited from carrying bags in certain locations. This includes places that the Supreme Court Justices discussed during their Bruen oral arguments (e.g. the subway). Gov. Hochul said none of the new policies were meant to focus on lawful gun owners. Hochul stated that the new policies were not meant to be focused on lawful gun owners.
Red Tape and Gun-Free Zones
The gun control package covers a wide range of locations, including government buildings and health care facilities, places for worship, libraries and public playgrounds and parks. It also includes shelters, public transit, shelters, mental health centers, addiction and mental hospitals, shelters, shelters, polling places, casinos, stadiums, museums, stadiums, and stadiums.
Even Times Square in New York City has been declared a “gun-free” zone. Private property is considered a “sensitive area” unless a sign is posted by the property owner. Signs must be posted so that law-abiding citizens can exercise their right to carry a firearm publically for self-defense.
New York’s new laws require applicants to complete 16 hours of training in-person and hours at a firing range. They will also need to interview in person, provide information about their household members, update their social media accounts, and renew their license after three-years.

Other provisions require background checks to be completed for any ammunition purchases that require a permit. New rules are also in place for firearm storage in homes, which Heller deemed a violation to the Second Amendment.
New York is simply pointing its nose at Supreme Court.
California
California Attorney General Rob Bonta issued a directive instructing state law enforcement to “cease any ‘good cause’ requirements” for concealed carry applicants.
AG Bonta wrote that “The Attorney General’s opinion is that the court’s ruling renders California’s good reason standard to secure a permit for concealed weapons in most public places unconstitutional.” “Permitting agencies no longer need to demonstrate good cause.”

AG Bonta dipped a little, however, adding that “It remains reasonable –and constitutional — to question applicants why they are interested carrying their firearms out in public” and that applicants should still show proof of “good moral character.”
AG Bonta’s office released a trove California gun owner information in publicly accessible files, which included identifying information, just days after the Supreme Court handed down its Bruen decision.
According to The Reload, the leaked information includes the person’s full name, race and home address as well as their date of birth and permit date. The data also indicates whether the permit holder is a member or a judge.
AG Bonta’s Office released a milquetoast after the data release. It stated that “We are investigating an exposure to individuals’ personal information related to the DOJ Firearms Dashboard.” Any unauthorised release of personal data is unacceptable.

California Rifle & Pistol Association is assessing the extent of damage caused by AG Bonta’s gun owner data release. Chuck Michel, President of the CRPA, stated that litigation is likely.
Maryland and Massachusetts
Maryland Republican Governor. Larry Hogan also removed the “good and significant” reason requirements. Maryland gave the state’s pistol permit issuing authority the right to “use discretion” in issuing permits. No longer.
Governor Hogan announced that “In light the [Bruen] ruling, and to ensure compliance to the Constitution, I am directing Maryland State Police immediately to suspend the use of the ‘good cause’ standard when reviewing applications to wear and carry permits.” Hogan made the announcement. Hogan stated, “It would not be constitutional to continue enforcing that provision in state law.”
Maryland requires applicants for permits to be 21 years of age.

Maura Healy, Massachusetts Attorney General, followed suit and issued new guidance on July 4. She stated that they should not deny or impose restrictions upon licenses to carry guns just because an applicant doesn’t have a “good reason” to do so.
Monitoring the remaining states
The remaining states that have similar “may issue” permitting laws are also watching and considering next steps. It is extremely difficult to get a Hawaii handgun license. Applicants must show that they have an “exceptional” case and a reason to fear injury.
Honolulu police state that there are no immediate changes in the state’s process. However, gun rights groups hint at litigation. Similar “wait and see” situations are found in Connecticut, Rhode Island, and Delaware.
It is clear that the Bruen decision has already had an impact on law-abiding Americans’ ability obtain a concealed carry permit. It remains to be seen what other obstacles they will face in order to do so. These restrictions may also be challenged in court.
