Governor Newsom Attacks Gun Rights
California Gov. Gavin Newsom was angry at the recent U.S. Supreme Court decision in a Texas abortion case. He used the ruling to attack California’s law-abiding gun manufacturers and gun owners.
A Texas law that allowed average citizens to sue abortion clinics in Texas was upheld by the high court. Newsom’s Friday announcement details how an anti-gun measure was drafted. It allows Californians the right to sue gun distributors, gun manufacturers, and sellers of “assault weapon” in the Golden State.
Newsom shared a Twitter statement saying that he was outraged by the U.S. Supreme Court’s decision yesterday allowing Texas’s ban to most abortion services to continue in place. “If states can now shield laws from review by federal courts that compare assault weapons with Swiss Army knives, then California has the authority to protect people’s life, where Texas used it for women’s safety.”
Newsom expanded on this strange idea further: “I have directed staff to work with both the Legislature and Attorney General to create a right to action that would allow private citizens to seek injunctive Relief and statutory damages at least $10,000 per violation plus costs of attorney’s fees against anyone who manufactures, distributes, or sells an assault weapon, ghost gun kit, or parts in California. We should add the threat to private lawsuits to keep these deadly weapons off our streets.
Both the topics of abortion in Texas and semiauto firearms in California seem to be completely different. Newsom’s misuse of the Supreme Court precedent shows his decades-long struggle against gun rights and law-abiding gun owner.
Comparing Oranges and Apples
JD Washington writes at Liberty.loft.com and uses sound reasoning to explain why these topics are apples and oranges. This is despite Newsom’s blinders and the anti-gunners. Many in the mainstream media also gloated over Newsom’s announcement.
Washington wrote, “As has been repeatedly stated, the right to an abortion is not explicitly spelled out by the Constitution.” “The Supreme Court’s decisions in Roe v Wade, Planned Parenthood and Casey created the ‘right’ that the radical left claims. While our Constitution does not guarantee abortion rights, it does guarantee the right for life.
“The Supreme Court ruling does not change the fact a state can decide what they would like to do in the matter of abortion. Although the Supreme Court ruling does nothing to make abortion illegal, it does push the issue back to states for their decision since it is not a constitutional question.
Washington explained that the right to own a firearm is a very different thing.
He said that Newsom’s law would prevent anyone from obtaining a firearm. This right is clearly stated in the Constitution.” he added. “The Second Amendment states that ‘the right to keep and bear arms, shall not be violated.’ This is exactly what his law will accomplish.
“Newsom believes he has found a way around the Constitution by following Texas’ lead. But Texas never did.”
Absurd Acts
The National Rifle Association quickly criticized Newsom’s actions after Newsom made his announcement.
According to the NRA statement, “Newsom’s statement is made at a time when brazen crime continues plague the state.” “But, rather than focusing his attention on criminal conduct he continues harassing and demonizing law-abiding firearm owners. This bogus effort will be fought by the NRA in the legislature as well as the courts.
The NRA statement continued, “Gov. Newsom is misunderstanding the Supreme Court’s actions and the limits of his war against lawful gun ownership. His pledge to run roughshod on the Second Amendment is nothing more than political theater. He and his fellow Democrats should not proceed at their own risk: The American people won’t tolerate another taxpayer-funded attack on constitutional freedom.
