Speaker Nancy Pelosi expedited Friday’s vote to ban “assault weapon” in the House Judiciary Committee. Five House Democrats voted against the bill in the 217-213 vote. Two Republicans voted for it. The federal “Assault Weapons Ban of 2022”, which is now in the Senate, is unlikely to pass.
House passes bill to ban “assault weapons”
Fear of not enough votes, the vote on Wednesday to ban “assault weapons”, was canceled. Nancy Pelosi, House Speaker, stated that the vote would be moved to next month. But, Friday morning, just days later, she scheduled a last minute vote for that day. It passed.
According to The Hill, “The assault weapon ban legislation, led and co-sponsored 207 voting Democrats by Rep. David Cicilline (D-R.I.), specifically calls for the prohibition of the sale, manufacture transfer or import any semi-automatic assault weapons and semi-automatic guns, depending on their features.”
This vote is a knee-jerk response to recent mass shootings and is a rehash old, failed legislation. Similar to the 1994 ban on assault weapons, which lasted ten year, this legislation is symbolic and unconstitutional.
Breitbart’s 2013 report states that “Again-in 2011 less than.012 per cent of all deaths in America were linked to “assault arms” and there wasn’t even a ban. The ban’s impact on gun violence had been negligible in the years prior, 1994-2004.
The Wall Street Journal reported in 2013 that “since the Federal Assault Weapons Ban expired September 2004, murder and overall violent crime rates have fallen.” According to the Uniform Crime Report of the Federal Bureau of Investigation, the U.S. murder rates were 5.7 per 100,000 people in 2003, the last year before the law expired. The murder rate dropped to 4.7 per 100,000 by 2011. It is important to remember that only 2.6% of murders are committed with any type of rifle.
This legislation will not prevent gun violence, just like the previous legislation. In the face of rising violent crime, disarming law-abiding citizens only will increase public safety.
The Federal “Assault Weapon Ban”
The Hill continues to show examples of firearms that have been affected by the incident:
“For example, semi-automatic rifles with detachable magazines that have a pistol grip or forward grip, as well as a barrel shroud or folding, telescoping, or detachable stocks, are subject to the ban.”
The legislation also targets standard capacity magazines that have been renamed to “high capacity”.
Sec. 3 Restrictions on Assault Weapons & Large Capacity Ammunition Feeding devices states:
“It is illegal for any person to import, sell or manufacture large ammunition feeding devices.
The legislation defines “high-capacity” as any ammunition feeding device holding more than 15 rounds. The legislation does not apply to magazines with a high capacity that were lawfully owned before the enactment. The ban does not apply to any semiautomatic assault weapon lawfully purchased prior to the ban.
This bill comes at a moment when the support for semi-auto bans is declining in the United States. Gun ownership is on the rise. Similar results are shown by polls, which show that Americans reject more gun control by increasing margins.
Lawrence G. Keane (NSSF’s Senior Vice President, General Counsel) stated that “this legislation is as dangerous and revealing of how contempt the House Democrats hold for Constitution and the U.S. Supreme Court.” “Chairman Jerrold Nadler admitted during debate that he didn’t care that the legislation was unconstitutional. It defied Supreme Court precedent.” Instead of representing the interests of ‘the People’, Democratic representatives represent special-interest gun control organizations that seek to disarm law-abiding citizens as well as make them scapegoat for crimes committed by others.
It is not expected to pass the Senate
Although two Republican House members–Chris Jacobs of New York and Brian Fitzpatrick (Pa .)–crossed over the aisle and voted in support of the bill), it is unlikely that it will pass the Senate.
According to Hill, “Though it received bipartisan support from the House, the legislation has no chance of moving in the Senate due to widespread Republican opposition.”
NBC News also reports that “the level of GOP opposition suggests the bill is unlikely” to move in the evenly divided Senate. To defeat a guaranteed filibuster, it would need the support of at minimum 10 Republicans. It is not known if the measure has the support or opposition of all 50 Senate Democrats.
This is good news, but we must not lose our guard. The Democrats are determined to take away our Second Amendment rights. Although the evidence is clear that law-abiding gun owner are not the problem; violent criminals are. They are still being ignored, with the exceptions of soft on crime policies and “defund police” policies.
It is worth noting, however, that over 24 million AR- and AK-style rifles are in circulation across the United States. They would be a problem if they were, as gun control advocates and Democrats claim they are.
They are not responsible for the.012 percentage of American deaths. This is a clear indicator that gun violence is not the fault of law-abiding citizens.
Things will only get worse unless Democrats start to address the rise in violent crime in their cities.
