Important Second Amendment Case before the U.S. Supreme Court

The New York State gun control laws that make it nearly impossible to carry handguns within certain New York cities are at issue. Officially, this case is New York State Rifle & Pistol Association, Inc. v. Bruen. It could be the most important case regarding gun rights in the last decade. The Supreme Court’s decision could be the final confirmation that an individual has the right to self-defense beyond the home.
Dave Workman posted on Ammoland.com: “The case was accepted for review in the upcoming term which begins in October. It challenges New York’s restrictive requirement for anyone applying for a permit for carry of a handgun out of their home must present a ‘proper reason’ for wanting to protect themselves. This authority is often used to deny applicants their Second Amendment right to bear arms. The plaintiff New York State Rifle & Pistol Assn. (NYSRPA) and the Citizens Committee to Keep and Bear Arms, (CCKRBA), are challenging the restrictive laws.

This case will allow the High Court to clarify Second Amendment precedents, in addition to deciding on the NY restrictive laws. It has been more than a decade since District of Columbia v. Heller, when the Supreme Court ruled that Second Amendment protects the individual’s right to possess a handgun at home for self-defense. In McDonald’s v. City of Chicago, 2010, the Court ruled that the Second Amendment was a fundamental right that applies equally to all states.
The NRA-ILA says that the case is very important for Second Amendment Rights. This decision will have an impact on the laws in many states that restrict firearms outside of the home. This could be the most important Second Amendment decision after D.C. For more than a decade, the Supreme Court has not ruled on a major Second Amendment case. The composition of the Court has changed and could result in a wide-reaching decision that could impact multiple states.
Dave Workman explained that it has been more than ten year since the Supreme Court heard a Second Amendment case. Although the court has declined to hear several good gun rights cases, this was before the SCOTUS majority shifted with… three appointments made by former President Donald Trump[.] If the court rules against New York it will open the floodgates to similar challenges of laws from New Jersey, Maryland, and… other states where citizens have to provide a good cause’ for exercising their constitutional rights.
Alan Gottlieb, founder of SAF, stated that so-called “proper cause” requirements are routinely used in order to deny law-abiding citizens their right to carry firearms for personal defense outside their homes. These laws are arbitrary and place absurd authority in the hands local officials and their subordinates to deny citizens their constitutional rights to bear arms.

NRA-backed case against New York’s concealed carry laws will be heard by the U.S. Supreme Court.
Gottlieb said, “The Second Amendment should not be treated as the ugly stepchild of Bill of Rights. It is clear that the amendment protects the individual citizen’s right to keep and bear arms. This right extends far beyond one’s home. A right that is limited to someone’s home does not exist. The court has the opportunity to clarify this issue and settle an important constitutional question once and for all.
