Let’s say you’re carrying concealed firearm. You have been well trained on how to use it in self-defense situations. As you are walking home from work, a man approaches you and pushes you into an alleyway. The man then points a revolver with a sharp-nosed blade at you and demands your money and other valuables. Although this used to be a crime, Manhattan now only charges armed robbery with a misdemeanor. You are well-versed in handguns as well as ballistics. You’re unlikely to survive if he pulls the trigger while the gun is pointed at your face. You would be perfectly justified in pulling your own gun and protecting your life with deadly force. This is not the case in New York City. It can take years to get a concealed carry permit. It is almost impossible to get a concealed carry permit in Manhattan unless you are wealthy or have political connections. The only thing that will stop the above scenario from happening more often (which is a lot considering NYC saw its worst violent crime wave in years 2021), and that is fear of being convicted for armed robbery and spending 25 years in prison. Manhattanites, don’t panic! This deterrent is no more in place. This is thanks to Alvin Bragg, the new Manhattan District Attorney, who recently decided to prosecute armed theft as a misdemeanor. Memorandum Bragg sent a memo to his staff on his first day of employment stating that his office would not seek a “carceral sentence” except for homicides. He also stated that his office will not seek a “carceral sentence” in any other cases, such as domestic violence felonies, sex crimes, or public corruption. According to the memo, obtained by the New York Post, “Armed Robbers who use guns and other deadly weapons to stick up shops and other businesses will not be prosecuted for petty theft, a misdemeanor provided no victims were severely injured and there’s no ‘genuine danger of physical harm to anyone’.” Bragg also states that victims are “no genuine threat of physical harm” if they are robbed with a firearm. In most areas of the country, citizens with guns can shoot an armed robber. If the citizen feels that his or her life is at risk, they can shoot and robber. It’s easy to feel this way when a gun is pointed at your face. Gun safety dictates that if someone points a gun at your face, it is a “genuine danger of physical harm.” Armed Robbery is a class A felony and can lead to a maximum of 25 year imprisonment. As a petty theft charge, convicted armed criminals can spend up to 364 days in prison and a $1,000 fine. They will then be released by the state to endanger law-abiding citizens again. Not Well Received Unexpectedly, many law enforcement personnel didn’t like Bragg’s new directive. Patrick Lynch, president and largest union in the NYPD, stated that police officers do not want to be sent out to enforce laws the district attorneys won’t prosecute. “And there are already to many people who believe they can commit crimes and resist arrest, interfere avec police officers and face zero consequences,” Patrick Lynch, president of the largest union in NYPD, told the Post. Bragg has also drastically reduced the charges against certain residential burglars, drug dealers, or convicted criminals who were caught with weapons. Bragg might be surprised at the likely outcome of an increase in armed robbery rates. It won’t surprise anyone who is familiar with violent crime and those who perpetrate it. Manhattanites should get used to having guns in their faces and their property taken from them on the streets. Bragg at the DA’s will make it more likely that this happens.
