More Gun Control Groups Call for SCOTUS Court-Packing

Democrats are once again agitated about packing the U.S. Supreme Court after the unauthorised leak of an abortion opinion from the U.S. Supreme Court. This argument is not new and has been used by gun control advocates before. Gun control groups are now intensifying their court-packing efforts in an effort to stop the Second Amendment. This is before the Supreme Court has given a final opinion in New York State Rifle & Pistol Association v. Bruen, or finalized the opinion on the leaked abortion draft decision. There were calls for court-packing even before the nine justices heard arguments in the New York case challenging the states’ restrictive and arbitrary “may issue” concealed carry permit criteria. U.S. Senator Sheldon Whitehouse (D-RI) filed an amicus brief NYSRPA v. New York supporting restrictive guns control, but went beyond supporting the law with arguments that threatened to overthrow the court’s structure. After New York City changed the law in order to avoid the Court striking it down, the Supreme Court declared the case “moot”. Sen. Whitehouse wrote that the Court might be able to heal itself after New York City altered the law to avoid the Court striking down the law. The firm opposition Senate Republican Leader Mitch McConnell (R.Ky.), led a 2019 letter in which he condemned court-packing threats. He urged the justices not to rely on public opinion polls but to base their opinions on Constitutional interpretations. The letter was signed by 53 Republican senators. Sen. McConnell wrote, “It’s one thing to sell these ideas in Tweets and on the stump,” “But the Democrats’ amicus brief shows that their court-packing schemes are more than mere pandering. They are a direct threat to the independence and rights of all Americans.” It is foolish to expect a Supreme Court ruling. The justices’ questions revealed that they were suspicious of New York’s subjective qualifications for concealed carry permits. This decision will be the most important on gun rights since the 2010 McDonald’s decision. Gun control groups are acting like spoiled schoolchildren. They are throwing fits. They also want to change the structure of the court. Many of these groups met together to discuss how to change the rules to rig the system against law-abiding Americans. Hiding the Agenda Igor Volsky Executive Director of Guns Down America Matt Post of March for Our Lives Demand Justice’s Tamara Brummer, U.S. Rep. Mondaire (D-N.Y.), and a closed-door conversation about their desire to pack Supreme Court. They want more gun control-friendly justices who would legislate from their bench to restrict rights. Brummer believes that the Supreme Court has “always been an ideological battleground” and that liberals must push for more seats to protect progressive policy advances, such as gun control. Matt Post declared from the National Mall that “Their right not to own an assault rifle doesn’t outweigh their right to live.” Since 1934, civilian ownership of assault rifles (or automatic weapons used by military personnel) has been severely restricted. They have not been made or sold commercially since 1986. Volsky is a staunch supporter of gun control. Volsky is not only an affiliate of Guns Down America, but he also serves as vice president of Center for American Progress, a far-left think tank. In his ruling in Miller v. Bonta, last year, U.S. District Judge Roger Benitez overturned California’s 30-year-old ban against Modern Sporting Rifles (“MSRs”) in California. This caused a social media meltdown. The Controlling the Bench Through Legislation Rep. Jones never liked a gun control proposal. He supports court-packing so strongly that he has introduced legislation with fellow gun control Reps. Jerrold N.Y., Hank Johnson (D.Ga.), and Sen. Edward Markey. To pack the court, we must expand it. Rep. Jones stated, “To restore power to people, we must expand Supreme Court.” He must have forgotten the people who elected the president to nominate justices for the current court. This includes the two previous Democratic presidents who filled the vacancies. This does not include President Joe Biden’s recent confirmation and Judge Ketanji Jackson, the newest justice. Brown will be taking her seat after Justice Stephen Breyer officially retires. Voting and Buying These elected officials and groups are not only disregarding their oaths to defend the Constitution; they also ignore their obligation to “We the People.” In 2020 and 2021 there were more than 40,000,000 firearm purchases, with more than 14,000,000 being made by first-time buyers. 33 consecutive months of 1 million or more guns have been purchased as a result of the firearm buying boom. This includes historic numbers minorities, and more than 40% of first-time gun buyers were women who feel empowered by exercising their Second Amendment rights. Every poll shows Americans disapprove of restrictions on their right to own guns, with historic low levels supporting more gun control. It’s the reason why federal legislation, including Rep. Jones’s court-packing gun regulation bill, has largely stagnated and President Joe Biden is drawing the ire from gun control groups disappointed at his inability to achieve more. It is why David Chipman, his first nominee for the Bureau of Alcohol, Tobacco, Firearms and Explosives Director (ATF), was unable to win the support of Democrats in Congress and had his nomination withdrawn. Volsky’s discussion on expanding the gun control court-packing debate demonstrates why their efforts are failing. Preaching to the gun control choir will not make neighborhoods safer or stop criminals committing their crimes. Barack Obama, Democratic President, famously stated that “Elections have consequences”. The rules apply to everyone. Presidents can nominate justices to fill vacancies at the Supreme Court. Americans are accepting their Second Amendment rights by millions, and gun control groups are losing their argument. They are now calling for changes to the rules.
