President Biden ATF nominee David Chipman appears to be in trouble

David Chipman’s charm campaign to win the support of the U.S. Senate is failing. The President Joe Biden nominated the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) director. Even the most passionate gun control supporters in Congress admit it.

David Chipman Having Trouble Getting Approval to be an ATF Director

According to Politico, U.S. Senator Dick Durbin (D.Ill.), Chairman, stated that “there are a lot issues” surrounding Chipman’s nomination. Sen. Durbin stated that the whip count needed to line up the votes to confirm Chipman’s nomination is not at the right level, but that there is always a chance.

This is not the same endorsement Sen. Durbin gave Chipman in May’s confirmation hearing. Sen. Durbin described Chipman as “working tirelessly” for law enforcement safety, and “advancing bipartisan commonsense steps to protect gun owners.”

Even Sen. Durbin would find it difficult to accept such a proposal. I have made the offer publicly and will repeat it again. I’ve offered a $100 bill to the first person to name any bill that expanded Second Amendment rights that David Chipman supported. Chipman is not a Second Amendment supporter so no one has claimed the C note.

Sen. Durbin was not done there. He was so certain Chipman would pass confirmation, he called him “singularly placed to lead ATF.” He has the right qualities to lead ATF, according to me.

What has changed?

Americans aren’t thrilled that President Biden appointed a gun control lobbyist as the head of the bureau responsible for regulatory oversight over the firearms industry and law enforcement authority. It’s a move to punish the industry, and pursue gun control beyond legislative channels.

NSSF conducted polls in key states where senators are yet to make a decision on Chipman. The results were rejected by voters. Over half of the likely voters in Arizona, Maine and Montana, Pennsylvania, West Virginia, and Montana said they would not support Chipman as ATF head. This was more than two-thirds in West Virginia.

NSSF shared these results with senators from the affected states. NSSF purchased television advertising to remind voters to contact their senators to tell them to vote “no on Chipman” for the first time in its 60-year history. It has had an impact.

Senate Republican Whip John Thune, R-S.D. On the Senate floor, Thune (R-S.D.) announced that he would vote against Chipman’s nomination because of his advocacy for gun control including banning the AR-15 and Modern Sporting Rifle(MSR) as well as his disparaging remarks about gun owners.

Sen. Thune stated that Chipman does not respect the Second Amendment rights of Americans and that we cannot rely on him to do so.

Toomey comes out in opposition

Sen. Pat Toomey (Republican from Pennsylvania) said he would not support Chipman’s nomination because of his vocal support for gun controls measures. Sen. Mike Braun (R-Ind.) Sen. Mike Braun (R-Ind.) took to the Senate floor in protest of Chipman’s nomination.

Sen. Braun explained that “His statements have made it clear.” “If confirmed, he would fail to uphold Constitutional right to bear arm.”

Sen. Jerry Moran (R.Kan.) released a press release stating that “He is not the right choice to lead ATF for Americans, so I will strongly oppose his nomination.”

Sen. Steve Daines (R-Mont.) Sen. Steve Daines (R-Mont.) tweeted a video in which he objected to President Biden’s nomination and Sen. Chuck Schumer’s (D-N.Y.).

Senator Thom Tillis (R.N.C.) published an opinion piece in Fox News warning that Chipman had been on the wrong side during every debate about the Second Amendment and, if confirmed, he would implement radical gun control policies that the Democrats wouldn’t be able to pass.

Sen. Tim Scott (R.S.C.) tweeted that David Chipman was a partisan activist and unfit to lead ATF. His nomination is yet another sign that Democrats are determined not to respect the #2A rights law-abiding Americans.

Senator Marco Rubio (Republican from Florida) released a statement in opposition to Chipman. He also called on President Biden and Sen. Schumer to withdraw Chipman’s nomination.

In his statement, Sen. Rubio stated that either Senator Schumer should allow the Senate to vote on this nominee, or President Biden should withhold his nomination and nominate a consensus nominee to lead the agency. He also said that he would live up to his promise to work across party lines in order to restore Americans’ faith in law enforcement.

Next steps

The Senate Judiciary Committee deadlocked at 11-11, meaning Chipman’s nomination is still pending. His nomination was not approved, but it can be withdrawn if Sen. Schumer moves. According to the power-sharing agreement, Chipman’s nomination must be voted on immediately after the motion to discharge passes. Because he knows that the votes are not there, Sen. Schumer has not made the motion.

Only a few senators haven’t made Chipman their position. U.S. Senators Joe Manchin (D.W.V. Jon Tester (D-Mont. Jon Tester (D-Mont. NSSF continues to reach out to voters to remind them to vote “no” on Chipman.

Although this nomination is slowing down, it isn’t over. The Senate will continue to consider the nomination. However, it is possible that President Biden could nominate a gun control lobbyist to politicize the ATF. The ATF’s 5,000 agents deserve a fair leader. The firearm industry relies on everyone taking action now.
