Senate Reaches Bipartisan Gun Control Agreement over the Weekend

The Senate reached a bipartisan gun control deal over the weekend with 9 Democrats and 10 Republicans, as well as 1 Independent. The list of key elements was released, even though the legislation’s text is still not finalized. It appears to address the concerns of Republicans and remove some of the more serious items from previous proposals. There are still areas of concern. Not to mention that they still call it “gun control.” RELATEDSTORY “Protecting Our Kids Act”, passes the House. But, it is unlikely to pass the Senate Senate’s Bipartisan Gun Control Agreement. As I said, the actual legislation has not been finalized. I will only address what I know. We will compare the final text once it is available for consumption. The Senators who were involved in the agreement are: John Cornyn, R-Texas; Tho Tillis (R.N.C.); Roy Blunt (R.Mo. )Richard Burr, R-N.C. -Bill Cassidy, R-La. )Susan Collins (R-Maine)Lindsey Graham (R-S.C.)Rob Portman (R-Ohio)Mitt Romney (R-Utah)Pat Toomey (R-Pa.).Chris Murphy (D-Conn.)Kyrsten Sinema (D-Ariz.)Richard Blumenthal (D-Conn.)Cory Booker (D- N.J.)Chris Coons (D-Del. )Martin Heinrich, D-N.M. Mark Kelly (D.Ariz.), Joe Manchin (D.W.Va.), Debbie Stabenow(D-Mich.),Angus King (I.Maine) The proposed legislation specifically addresses mental health resources as well as hardening school security, as proposed by Republicans. It does contain “Red Flag” laws which could be misused. It is important to note, however, that the proposal does not include an “Assault Weapons” ban. According to the New York Post, “The framework of the agreement encourages states to enact red-flag laws, to expand mental health services in all 50 states, as well as allow searches of juvenile records during background checks for those under 21 and increase funds for school security and mental health programs.” The article continues, stating, “But absent from the agreement are a number of proposals sought by Biden and gun control advocates — including an assault weapons ban and an increase in the age to purchase semi-automatic rifles to 21 from 18.” The Proposed Legislation A press release from the bipartisan group includes a list of items in the proposed legislation: Intervention Orders Provides resources to states and tribes to create and administer laws that help ensure deadly weapons are kept out of the hands of individuals whom a court has determined to be a significant danger to themselves or others, consistent with state and federal due process and constitutional protections.Investment in Children and Family Mental Health Services National expansion of community behavioral health center model; major investments to increase access to mental health and suicide prevention programs; and other support services available in the community, including crisis and trauma intervention and recovery.Protections for Victims of Domestic Violence Convicted domestic violence abusers and individuals subject to domestic violence restraining orders are included in NICS, including those who have or have had a continuing relationship of a romantic or intimate nature.Funding for School-Based Mental Health and Supportive Services Invests in programs to expand mental health and supportive services in schools, including: early identification and intervention programs and school based mental health and wrap-around services.Funding for School Safety Resources Invests in programs to help institute safety measures in and around primary and secondary schools, support school violence prevention efforts and provide training to school personnel and students.Clarification of Definition of Federally Licensed Firearms Dealer Cracks down on criminals who illegally evade licensing requirements.Telehealth Investments Invests in programs that increase access to mental and behavioral health services for youth and families in crisis via telehealth.Under 21 Enhanced Review Process For buyers under 21 years of age, requires an investigative period to review juvenile and mental health records, including checks with state databases and local law enforcement.Penalties for Straw Purchasing Cracks down on criminals who illegally straw purchase and traffic guns.Actual Compromise Although gun control in itself goes against our Second Amendment, at least this proposal features actual compromise. While most gun-grabbing items on the wish list didn’t make it into the final version, there were real and effective alternatives. This proposal would replace “Protecting Our Kids Act”, which passed the House, but is expected die in the Senate. A recent Reuters article lists the items in this proposal and compares what was cut. As such, we will monitor the legislation as it is finalized and will provide updates when it is available. We will be watching closely to see if they call it gun control. This legislation seems to have enough Republican support to pass the filibuster, given the items included. There are legitimate items that will improve school safety. However, there are also concerns. If your senator is on the above list, you can call their office to voice your concern about the misuse of the “Red Flag” laws. These could be used to harass law-abiding gun owners by “Swatting” and other false reporting. Remember that there is a current campaign to label Republicans “Domestic Terrorists” across media, government, and social media. That sounds especially alarming to me. We should all be concerned about the potential consequences. This has all the hallmarks a Trojan Horse. While some of these items may look appealing, we should be cautious.
