U.S. House of Representatives votes for gun control

June 10, 2022 – The “Protecting Our Kids Act” (POKA) was passed by the U.S. House of Representatives earlier this week. The new legislation includes eight new statutes. These are covered below. Voting primarily on party lines, the Democratic-majority House approved the eight measures that collectively comprise POKA by a 223-204 vote.NOTE: No part of POKA has become actual Federal law yet — it has only made it through the Democratic-controlled U.S. House of Representatives. To make any part of POKA law, it must be approved by the U.S. Senate. Then, President Biden must sign the legislation. Anthony Brown’s Raise the Age Act — This increases the legal age to buy a semi-automatic weapon from 18 to 21. David Cicilline’s Untraceable Firearms Act — This makes so called “ghost guns” subject the existing federal firearms regulations. Ted Deutch’s Keep Americans Safe Act — This new Full-Capacity Mag ban would prohibit the sale, manufacture, or possession of new gun magazines that contain more than 15 rounds. Robin Kelly’s Prevent Gun Trafficking Act — This creates federal offenses for gun trading and straw buying. Dina Titus’s End Bump Stock Loophole Act — This extends the Biden Executive orders by banning the manufacture sale and possession of Civilian bump stock.6-8 Gun Storage Regulations — There’s three Gun Storage proposals that mandate gun storage: Rosa DeLauro’s Ethan’s Law, Elissa slotkin’s Safe Guns, Safe Kids Act, Sheila Jackson Lee’s Firearm Safe Storage Act, and Elissa Slotkin’s Safe Guns, Safe Kids Act. GunsAmerica Digest reports that only two Democrats – Reps. He continued, “Many of these ideas in this legislative package were unconstitutional, including denying Second Amendment Rights to adults under 21?.” The U.S. Court of Appeals, Ninth Circuit has just ruled California’s age-based gun ban unconstitutional. “Here’s an analysis of the POKA legislation, as provided by the NRA Institute for Legislative Action. The law would prohibit law-abiding 18-20-year-olds from purchasing semi-automatic rifles or shotguns. This unconstitutional legislation would end law-abiding adults’ Second Amendment rights. It contends that these individuals can be trusted to follow the law, even though they are capable of protecting their country and voting in elections. H.R. 7910 would generally ban standard-capacity magazines that are overwhelmingly popular with law-abiding Americans for self-defense, as well as redirect federal tax dollars intended for law enforcement and other public safety programs to “buyback” existing lawfully-possessed magazines.Furthermore, H.R. H.R. 7910 contains several “safe storage” mandates to regulate how Americans store firearms in their homes. These provisions are directly contrary to the U.S. Supreme Court’s Heller decision, which ruled that mandatory storage provisions that restrict a law-abiding American’s right to have ready access to a firearm for self defense are unconstitutional. 2377 is a combination legislative proposals that create’red flag order’ which allow for the confiscation and destruction of firearms without due process. The legislation would give federal judges the power to nullify Second Amendment rights in each case and to issue orders to seize firearms from named individuals. H.R. H.R. 2377 would remove Second Amendment rights by confiscating firearms without constitutional due procedure by allowing courts ex parte (meaning that the accused is not present), firearm confiscation orders. A person could be forcibly disarmed of otherwise lawfully-possessed firearms before he or she had so much as an opportunity to contest the accusations – this would represent a clear denial of constitutional due process protections.Moreover, H.R. H.R. 2377 would allow indefinite firearm deprivations. Courts could issue orders without a time limit or allow for indefinite renewals. This legislation treats the Second Amendment in a second-class, disfavored way and ignores due process, the presumption of innocent and fundamental fairness.
