California politicians are using their legislative authority to create political reprisal bills. Left coast lawmakers want a law that allows the state’s attorney general, the city or county attorneys or anyone, regardless of whether they have suffered harm, to sue gun industry, including the makers and sellers of illegally inflicted harm firearms. Gavin Newsom requested it and Democrat state Senator Robert Hertzberg delivered with SB 1327. It targets precursor parts that are used to make personal-made firearms, or so-called ghost weapons. It also targets Modern Sporting Rifles, (MSRs), and.50-caliber rifles which are both already illegal in California. Gov. Newsom acknowledged that this legislation was political reprisal. Worse, the bill attempts to open floodgates against firearm industry because Newsom despises it. It provides the means for law-abiding citizens exercising their Second Amendment rights. His contempt is due. The worst part is that Governor. Newsom and his gun control comrades in California’s legislature are mocking their own voters. They are using the power voters give them to abuse the legislative process. They score political points with gun control donors who are special-interest gun control donors. They know they can do it. Qualified immunity protects elected officials from civil lawsuits. When President Joe Biden shouts from the White House Rose Garden that he wants to repeal the Protection of Lawful Commerce in Arms Act, which prohibits frivolous lawsuits against firearm companies for the criminal actions of third parties, he intentionally misleads Americans. It is not possible to sue politicians for harmful laws they create. But what if they were able to be sued? Crime Victims: What if crime victims could sue the Gov. Newsom or President Biden failed to enforce laws that protect communities. This question is pertinent, especially in California. The ire of law enforcement officials and citizens alike has been directed at George Gascon, District Attorney. Gascon’s soft-on crime approach to violent criminal offenders is what has caused this ire. After being charged with the shooting and murder of a delivery driver in an armed robbery in 2018, Luis Angel Hernandez, a convicted gang member, boasted that he was going have Gascon’s face tattooed. Gascon faces recall by voters with 300,000. The deadline is still two months away. According to the Los Angeles Association of Deputy District Attorneys, (LAADDA), 98 percent of Los Angeles prosecutors support recalling their clients. Gascon’s worst outcome is losing his job. What if victims of crimes could sue Gascon to recover damages for their injuries? Firearm Industry: What if business owners and corporations could sue legislators for deliberately maligning, harming, or enacting laws that cause irreparable damage? What if those businesses, like the firearm industry, were Constitutionally-protected and politicians like Gov. To drive these companies out of business, Newsom deliberately ignored this. Gun retailers and gun makers would be able to bring a case against California for its Unsafe Handgun Roster, which sets in motion a slow-rolling ban on handguns. The law, which was enacted in 2001, requires handguns to be certified for three safety requirements. The 2013 update to the requirement requires all semiautomatic handguns to be equipped with microstamping technology. This has reduced the number of handguns that Californians have from 967 models at the time the law was enacted by the then-AttorneyGeneral Kamala Harris to less 250 models when different paint schemes are considered. Since microstamping is technologically unfeasible, this is a law specifically enacted to deprive firearm businesses their ability to sell a lawfully-made and Constitutionally-protected product. Similar arguments could be made for California’s ban against traditional hunting ammunition. These laws are being enacted by state lawmakers as a retaliation against the firearm industry. They know that microstamping is impossible and that the ban on hunting ammunition in the state is not supported by scientific data. It is a way to make it more difficult to serve California customers. Gun Owners What about gun owners left defenseless against criminal home invaders because of intentionally-discriminatory laws depriving them of their right to keep and bear arms? California legislators banned anyone under 21 from purchasing firearms, with some exceptions. This law enacts an age-based ban on firearm purchases for adults over 18, who have an interest to their civil rights, except that they can legally purchase a firearm. Fredrick Wesley was recently arrested in Stockton, Calif. for a home invasion that left one adult dead and the other wounded. Three children, aged 10, 12, and 9, were among the victims. A further 18-year-old was also present. California law prohibits an 18-year old from purchasing a firearm to defend himself and his family. California legislators won’t have any responsibility for the 18-year-old’s refusal to purchase a firearm to protect him and his family. Qualified immunity protects them from any damages that may be inflicted on the family. Liberal politicians want to take away the qualified immunity that police officers enjoy. California’s legislators are not held accountable for their executive and legislative authority. It doesn’t matter how harmful it is for their citizens.
