Washington banned the sale of magazines with high capacity (or standard capacity) on July 1. The ban on “high-capacity” magazines was not only for retailers, but also for manufacturers. The ban will lead to fines and/or jail sentences for anyone who imports, manufactures, or distributes magazines with more than ten rounds. ZEV Technologies is now creative due to the Washington magazine ban.
Washington State Institutes Magazine Ban on “High Capacity”
Gov Jay Inslee is pursuing law-abiding gun owners to reduce gun violence. The new gun law, which bans the sale of “large capacity” magazines, is part of a larger gun control package, which also includes restrictions on “ghost guns.”
According to Guardian, “Violations of the law would be a misdemeanor punishable by up 90 days in prison and fines up to $1,000.” A gross misdemeanor would be any second or subsequent violation.
A Washington gross misdemeanor can result in up to 364 days imprisonment and a maximum $5,000 fine. A conviction will result in the suspension of a concealed carry permit for three years.
Again, Democrats have law enforcement following lawful gun owners and makers while ignoring criminals.
Attorney General Bob Ferguson requested the measure initially and now faces a legal battle. Sullivan v Ferguson is a case that challenges the ban on standard-capacity magazines. FPC (Firearms Policy Coalition) is leading the charge.
Ferguson is certain that the challenge won’t succeed because multiple circuit and appellate courts will uphold the restrictions. The challenge is now a reality, however, due to New York State Rifle & Pistol Association, Inc. v. Bruen.
The Center Square in Washington wrote, “The Supreme Court’s new order requires that the 9th Circuit revisits that decision using new guidance from the Supreme Court in New York State Rifle & Pistol Association, Inc. v. Bruen, where the majority held that Americans have constitutional rights to carry firearms.”
This legal battle will set a precedent for all of us. Please donate to the FPC if you wish to be a part of this Second Amendment fight.
ZEV Technologies joins the Fight
ZEV Technologies is joining the challenge. It is putting its money where it is needed. The company announced that a portion of every firearm sale will be donated to the FPC.
ZEV, a Washington-based business, is directly affected by this ban. The company cannot sell standard capacity magazines. The ban does not apply to customers outside of the state.
“ZEV Technologies is very disappointed in the WA State Legislature’s passing of such an unjust law. This law severely restricts our unalienable right, ability to conduct business in a normal way and service our customers without infringement. ZEV will continue fighting anti 2A legislation. “We are embedded for the duration these legal battles,” said Dan Groce (Director of Brand Engagement).
Creative Alternatives
The company is not only joining the fight against anti Second Amendment legislation, but also working to make things right with its customers.
This has led to the company joining forces with another company, MAGPUL, that was subject to similar legislation in Colorado. In the ZEV firearm’s case, you will find an explanation about the 10-round magazine and a $20 MAGPUL gift certificate.
We reached out to Dave Roberts (SVP, Creative and Brand Marketing at ZEV Technologies) about the program. When asked how ZEV Technologies came up with the idea of offering a gift card, Roberts replied:
“We have always worked closely with the great people at MAGPUL. After Washington announced the ban on magazines, one of their guys and I discussed this idea. It’s our way to say sorry to the customer for something that is beyond our control. The gift card can be used to purchase anything on MAGPUL’s website. If legal, the gift card can be used to purchase anything on the MAGPUL website.
This comes at a cost for the company, but it’s one they find well worth.
“We used to ship every firearm equipped with two high-capacity magazines. But now we can only ship with 10-round magazines. We made the difficult decision to limit our supply to one 10-round magazine. A MAGPUL gift card is also available. For every firearm purchased, we donate a portion of the proceeds to the FPC Constitution Alliance in support of your Second Amendment rights. Although this has cost ZEV more money, we believe it’s well worth it.
You’re not only getting a high-quality firearm but you’re also joining the fight. It’s a good fight.
